1. Agreement to Terms

By accessing or using Ink Reminders ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Ink Reminders is an automated email reminder service designed for tattoo artists. The Service integrates with your Google Calendar to identify appointments and sends automated reminder emails, aftercare instructions, and follow-up messages to your clients on your behalf.

3. Account Registration

To use the Service, you must:

  • Create an account using Google OAuth
  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Be at least 18 years of age
  • Accept responsibility for all activities under your account

4. Subscription and Payment

  • The Service is offered on a monthly subscription basis at £12 per month
  • Payment is processed securely through Stripe
  • Your subscription will automatically renew each month unless cancelled
  • You may cancel your subscription at any time from your account settings
  • No refunds are provided for partial months of service
  • We reserve the right to change pricing with 30 days notice

5. Acceptable Use

You agree not to use the Service to:

  • Send spam or unsolicited commercial communications
  • Send emails to anyone who has not consented to receive them
  • Harass, abuse, or harm another person
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Transmit malware or other harmful code
  • Attempt to gain unauthorised access to the Service

6. Client Data and Consent

You represent and warrant that:

  • You have obtained appropriate consent from your clients to send them emails
  • The client email addresses you provide are accurate and belong to your actual clients
  • You will comply with all applicable data protection and email marketing laws (including GDPR and PECR)
  • You will promptly remove any client who requests to stop receiving emails

7. Google Calendar Integration

By connecting your Google Calendar, you:

  • Grant us read-only access to your calendar events
  • Acknowledge that we use this data solely to identify appointments and trigger reminders
  • Can disconnect your calendar at any time from your dashboard

8. Email Content

You are responsible for the content of emails sent through the Service, including any customisations you make to email templates. Emails are sent on your behalf and from your business. We provide default templates as a convenience, but you should review and customise them to suit your needs.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may modify, suspend, or discontinue the Service at any time with reasonable notice. We are not liable for any downtime or service interruptions.

10. Limitation of Liability

To the maximum extent permitted by law, Ink Reminders shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be error-free, secure, or available at all times. We do not guarantee that emails will be delivered or that no-shows will be prevented.

12. Indemnification

You agree to indemnify and hold harmless Ink Reminders from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service will cease immediately.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by email or through the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
